Categories of Personal Information We “Sell”, “Share”, or Process for "Targeted Advertising”
Certain data collection and disclosures related to you and your activity on our Services may be considered a “sale” or “sharing”, or constitute the processing of your personal information for “targeted advertising”, under applicable State Privacy Laws. As defined by State Privacy Laws, we “sold” or “shared” or processed for “targeted advertising” certain data elements within the following categories of personal information: Identifiers; Commercial Information; Internet Activity; Imprecise Geolocation Data; Audio and Visual Information; Professional and Employment Information; Education Information; Biometric Information; Sensitive Personal Information; and Inferences. We “sold,” “shared,” or disclosed for the purpose of “targeted advertising,” each category to business partners and other third parties as described in Section 8 of our Privacy Policy.
The purposes for which we "sell," "share," or process your personal information for "targeted advertising" are to serve, deliver, and measure advertising on our Services and on third parties' services; to offer Services that include registrations, event tickets and related custom items, livestreams and archived content, and fundraising opportunities on behalf of a Customer; to provide our Services requested by you; to provide scouting tools; to market our and our partners' products and services to you; and to provide an enhanced experience that integrates with Social Media and other third-party services, as further described in Sections 1 and 8 of our Privacy Policy.
Where applicable law requires opt-in consent before we “sell” or “share” the personal information of a known minor, we obtain that consent as described in Sections 3 and 9 of our Privacy Policy.
For California residents: if you are age 16 or older, you have the right to direct us not to "sell" or "share" (as either term is defined in your applicable State Privacy Law) your personal information at any time (the “right to opt-out”) using the methods described in Section 3 of this State Privacy Policy. If we actually know you are aged 13 to 15, you must give us affirmative authorization (the “right to opt-in”) in order for us to "sell" or "share" your personal information. If we actually know you are under age 13, you must have your parent or guardian give us affirmative authorization (the “right to opt-in”) on your behalf in order for us to “sell” or “share” your personal information. California residents who opt-in to personal information sales or shares may opt-out of future sales or shares at any time. We handle the personal information of children under 13 as described in Section 9 of our Privacy Policy, consistent with the Children's Online Privacy Protection Act (COPPA).
If you would like to opt out of the processing of your personal information for “targeted advertising” or the “sale” or “sharing” of your personal information, you may click the “Your Privacy Choices” link in our website footer or use our request form, as further described in Section 3 of this State Privacy Policy.
You do not need to create an account to exercise your opt-out rights.
We will only use personal information provided in an opt-out request to review and comply with the request. You may change your mind and opt back in at any time by emailing support@hudl.com.
Sensitive Personal Information
Some of the personal information we collect is "sensitive personal information" or "sensitive data" under the State Privacy Laws. This may include certain Wearable Data (as defined in our Privacy Policy), the personal information of minors (including the personal information of minors under age 16 in California), health information, biometric information, the contents of communications you send and receive through the Services where we are not the intended recipient, and your account log-in credentials in combination with a password or other access credential.
Depending on your applicable State Privacy Law, you may have the right to limit our use and disclosure of your sensitive personal information to those purposes necessary to provide the Services and other purposes permitted by law (sometimes called the right to "opt out" of certain uses of sensitive data). To exercise this right, you may submit a request using our request form, or contact us using the methods in Section 3 of this State Privacy Policy.
Where a State Privacy Law requires your consent before we process sensitive personal information or data, we obtain that consent before processing, including, where required, the consent of their parent/legal guardian. Where we rely on your consent, you have the right to withdraw it at any time. To withdraw your consent, please contact support@hudl.com. Withdrawing consent will not affect processing we carried out before you withdrew it, and may affect your ability to use features that depend on that data. You do not need to create an account to exercise these rights.
De-Identified Data
In some cases, we de-identify or aggregate personal information so that it can no longer reasonably be linked to you or your household, and we may use and disclose that de-identified or aggregated data for any lawful business purpose, such as analytics, research, benchmarking, product development, and improving our Services, among other purposes. Where we maintain data in such de-identified or aggregated form, we take reasonable measures to ensure it cannot be associated with you or your household, we maintain and use the data only in de-identified or aggregated form, and we do not attempt to re-identify it (except as permitted by applicable law). Any such de-identified or aggregated information is not "personal information" or "personal data" as defined under applicable State Privacy Laws and is therefore not subject to the rights and disclosures described in this State Privacy Policy.
Timeframe for Retaining Personal Information
We retain personal information only for as long as reasonably necessary for the purposes described in this State Privacy Policy and our Privacy Policy. We determine the appropriate retention period using criteria such as the amount, nature, and sensitivity of the personal information; the potential risk of harm from unauthorized use or disclosure; the purposes for which we use it and whether we can achieve those purposes by other means; and applicable legal, contractual, accounting, and reporting requirements. For a full description of how we retain and delete personal information, see Section 15 of our Privacy Policy.
If you have any questions about this State Privacy Policy, please contact us using the methods described in Section 22 of our Privacy Policy or email support@hudl.com.
Hudl may periodically update this State Privacy Policy. The most current version of this State Privacy Policy will govern our use of your information and will be available at https://www.hudl.com/privacy/us-states. By using our Services, you acknowledge that you have read and understood this State Privacy Policy. For details on how we notify you of material changes to this State Privacy Policy or our Privacy Policy, please see Section 23 of our Privacy Policy.
